By accessing, browsing, or using the website located at prioritypostexpress.com or by utilizing any service offered by Priority Post Express LLC ("Company," "we," "our," or "us"), you ("User," "Customer," or "you") acknowledge that you have read, understood, and agree to be legally bound by these Terms and Conditions ("Terms"), along with our Privacy Policy and any other policies incorporated herein by reference.
If you do not agree with any part of these Terms, you must immediately discontinue use of our website and services. Your continued use of our services following any modifications to these Terms constitutes your acceptance of the revised Terms.
These Terms apply to all visitors, users, customers, and others who access or use our services, including online shipping tools, tracking systems, account management portals, and customer support.
Services Description
Priority Post Express provides domestic and international courier, parcel delivery, freight, and logistics services throughout the United States and to destinations worldwide. Our services include but are not limited to:
- Same-day, next-day, and standard domestic delivery services across all 50 U.S. states
- International express and economy shipping to 120+ countries and territories
- Real-time parcel tracking and trace services available at prioritypostexpress.com/track-and-trace
- Freight forwarding, customs brokerage, and import/export assistance
- Business shipping accounts, API integrations, and bulk shipping solutions
- Packaging, insurance add-ons, and special handling for fragile or high-value items
- Pick-up scheduling and drop-off location services
We reserve the right to modify, suspend, or discontinue any aspect of our services at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of services.
Eligibility & Account Registration
To use certain features of our services, you may be required to register for an account. By registering, you represent and warrant that:
- You are at least 18 years of age or the age of majority in your jurisdiction
- You have the legal capacity to enter into binding contracts under applicable law
- All registration information you submit is truthful, accurate, current, and complete
- You will maintain and promptly update your account information to keep it accurate
- You are responsible for maintaining the confidentiality of your account credentials
- You will notify us immediately of any unauthorized use of your account
- You will not share your account credentials with any third party
We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders at our sole discretion if we believe these Terms have been violated.
You are fully responsible for all activities that occur under your account, regardless of whether such activities are authorized by you. Priority Post Express will not be held liable for any loss or damage arising from your failure to protect your account information.
Shipping & Delivery Terms
When you place a shipment order with Priority Post Express, you acknowledge and agree to the following conditions governing the handling and delivery of your parcels:

Delivery time estimates are not guaranteed unless explicitly stated. Transit times may be affected by weather, natural disasters, customs delays, incorrect addressing, recipient unavailability, or other circumstances beyond our reasonable control. Priority Post Express shall not be liable for consequential damages resulting from late deliveries.
The shipper is responsible for ensuring that the recipient's address is accurate and complete. We are not responsible for failed deliveries resulting from incorrect or incomplete addresses provided by the shipper. Address correction fees may apply.
Delivery confirmation is electronically recorded for all shipments. If a delivery attempt is made and the recipient is unavailable, we will leave a notification and attempt redelivery up to two (2) additional times before returning the parcel to the sender.
Prohibited Items
You agree not to ship any items that are prohibited by U.S. federal law, state law, or applicable international law, or any items that Priority Post Express deems unsafe, hazardous, or inappropriate. Prohibited items include but are not limited to:
- Firearms, ammunition, explosives, and other weapons or weapon components
- Illegal narcotics, controlled substances, and drug paraphernalia
- Hazardous materials including flammable, corrosive, toxic, or radioactive substances not properly classified and labeled
- Live animals, plants, or biological specimens not compliant with USDA and CITES regulations
- Perishable food items without appropriate refrigeration documentation
- Counterfeit goods, pirated software, or items infringing upon intellectual property rights
- Human remains, organs, or biological waste
- Currency, negotiable instruments, or bearer bonds exceeding regulatory thresholds
- Pornographic or obscene materials
- Items subject to trade sanctions, embargoes, or export control regulations
Shipping prohibited items may result in immediate account termination, forfeiture of shipment, and referral to appropriate law enforcement authorities. The shipper assumes full legal liability for any consequences arising from shipment of prohibited items.
Fees, Rates & Payment
All shipping rates, service fees, surcharges, and applicable taxes are presented at the time of booking. By confirming a shipment, you authorize Priority Post Express to charge the stated amount to your selected payment method. The following payment terms apply:
- All fees are quoted and charged in U.S. Dollars (USD) unless otherwise specified
- Applicable federal, state, and local taxes will be added where required by law
- Fuel surcharges, residential delivery fees, oversized package surcharges, and remote area surcharges may apply and are subject to change without notice
- For business accounts, invoices are payable within thirty (30) days of issuance unless a different term is agreed upon in writing
- Overdue balances are subject to a late payment fee of 1.5% per month or the maximum rate permitted by law, whichever is lower
- We accept all major credit and debit cards, ACH bank transfers, and approved digital payment methods
- All sales are final. Refunds, where applicable, are governed by our Refund Policy
We reserve the right to modify our pricing at any time. Price changes will not affect confirmed shipments already in transit.
Liability & Claims
Priority Post Express takes every reasonable precaution to ensure the safe and timely delivery of your shipments. However, our liability is subject to the following limitations:
- Our maximum liability for loss or damage to any single shipment is limited to $100 USD unless additional declared value coverage is purchased at the time of shipment
- We are not liable for damage to improperly packaged items, inherently fragile goods, or items that do not comply with our packaging guidelines
- We are not liable for indirect, consequential, incidental, punitive, or special damages arising from any loss or delay
- Claims for loss or damage must be filed in writing within thirty (30) calendar days of the shipment date
- Claims for non-delivery must be filed within sixty (60) calendar days of the shipment date
- We are not liable for delays resulting from force majeure events, customs inspections, or incorrect address information

Insurance
Priority Post Express offers optional declared value coverage for shipments exceeding the standard liability limit of $100 USD. Declared value coverage is not the same as insurance; it represents the maximum extent of our liability in the event of loss or damage.
- Declared value must be accurately stated at the time of booking; fraudulent declarations are prohibited
- Coverage does not apply to prohibited items, perishables, cash, or items excluded under these Terms
- For high-value shipments exceeding $10,000 USD, we strongly recommend obtaining a third-party cargo insurance policy
- Declared value fees are non-refundable once a shipment has been accepted
- Any claims under declared value coverage are subject to verification and investigation prior to settlement
Intellectual Property
All content, materials, trademarks, service marks, logos, trade names, and intellectual property displayed on the Priority Post Express website and associated platforms are the exclusive property of Priority Post Express LLC or its licensors, and are protected under applicable U.S. and international intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use our website and services solely for personal or business shipping purposes. You may not:
- Copy, reproduce, distribute, or create derivative works from our content without express written consent
- Use any data mining, robots, scrapers, or similar data gathering tools on our platform
- Remove, alter, or obscure any proprietary notices, labels, or markings on our materials
- Use our trademarks, logos, or brand elements in any manner likely to cause confusion or imply endorsement
- Reverse-engineer, decompile, or attempt to extract source code from any of our software systems
Privacy & Data Use

Indemnification

Disclaimer of Warranties
OUR SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND. To the fullest extent permitted by applicable law, Priority Post Express expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that:
- Our services will be uninterrupted, timely, secure, or error-free
- Any results obtained from use of our services will be accurate, reliable, or complete
- Any defects or errors will be corrected
- Our platform is free of viruses, harmful components, or other malicious code
Some jurisdictions do not allow the exclusion of certain warranties, so the above exclusions may not fully apply to you. In such cases, our liability is limited to the maximum extent permitted by applicable law.
Limitation of Liability
To the fullest extent permitted by applicable U.S. law, in no event shall Priority Post Express LLC, its directors, officers, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to:
- Loss of profits, revenue, or business opportunities
- Loss of data, goodwill, or other intangible losses
- Damages resulting from unauthorized access or alteration of transmissions or data
- Damages resulting from the conduct of any third party on or through our services
- Any other matter relating to our services
Our total aggregate liability to you for any claim arising out of or relating to these Terms or our services shall not exceed the greater of: (a) the total fees paid by you to Priority Post Express in the ninety (90) days preceding the claim, or (b) one hundred U.S. dollars ($100.00).
Governing Law
These Terms and Conditions, and any disputes arising out of or related to them or your use of our services, shall be governed by and construed in accordance with the laws of the State of Delaware, United States of America, without regard to its conflict of law provisions.
To the extent that any lawsuit or court proceeding is permitted under these Terms, you and Priority Post Express agree to submit to the personal and exclusive jurisdiction of the state and federal courts located in Delaware, USA.
These Terms will not be governed by the United Nations Convention on Contracts for the International Sale of Goods (CISG), the application of which is expressly excluded.
Dispute Resolution & Arbitration
We encourage you to contact us first to resolve any concerns informally. If a dispute cannot be resolved informally, the following provisions apply:
- Mandatory Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or your use of our services shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules
- Class Action Waiver: You waive any right to participate in a class action lawsuit or class-wide arbitration against Priority Post Express
- Small Claims Exception: Either party may bring an individual claim in small claims court if it qualifies under applicable small claims court rules
- Arbitration Location: Arbitration shall be conducted in Delaware, USA, or via remote hearing as agreed by the parties
- Cost Allocation: Each party shall bear its own arbitration fees, except as otherwise awarded by the arbitrator
Before initiating arbitration, you must first send a written notice of your dispute to our legal department via the contact information in Section 18. We have sixty (60) days from receipt to resolve the dispute informally.
Modifications to Terms
Priority Post Express reserves the right to revise, amend, or update these Terms at any time and in our sole discretion. When we make material changes, we will notify you through one or more of the following methods:
- Posting a prominent notice on our homepage at prioritypostexpress.com
- Sending an email notification to the address associated with your registered account
- Displaying an in-app or in-portal notification at your next login
Changes take effect immediately upon posting unless otherwise stated. Your continued use of our services following notification of any changes constitutes your binding acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using our services immediately.
Termination
Priority Post Express may, at its sole discretion and without prior notice or liability, suspend, restrict, or permanently terminate your access to any or all of our services, for any reason, including but not limited to:
- Breach of any provision of these Terms or our policies
- Fraudulent, deceptive, or illegal activity associated with your account or shipments
- Failure to pay outstanding balances within applicable payment terms
- Requests from law enforcement or government agencies
- Extended periods of account inactivity
Upon termination, your right to use our services ceases immediately. All provisions of these Terms which by their nature should survive termination shall survive, including intellectual property provisions, disclaimers, indemnity obligations, and limitations of liability.
You may terminate your account at any time by contacting us at prioritypostexpress.com/contact. Termination does not relieve you of any outstanding payment obligations.

Severability & Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published on our website, constitute the entire agreement between you and Priority Post Express with respect to your use of our services, superseding all prior or contemporaneous understandings and agreements.
